Objetive :

Our general terms and conditions of sale have as their objective “defining Les Montres de Prestige contractual relationships with our client base. Our general terms and conditions of sale will prevail over any other conditions that may appear in any other document, with the except of preliminary, express and written wavers.

Acceptance of Terms and Conditions :

These terms and conditions of sale will be considered authorized and accepted by the client’s signature on said order declaring their acceptance without reservation. Terms and conditions of sale determine the contractual relationship between Les Montres de Prestige and their client, with both parties accepting said terms and conditions without reservation.

Products :

All proposed products on our web site are now available with photographs illustrating our products as part of our contractual obligation.

Order :

Our automatic registration systems are considered are taken as legal proof of the nature, contents and date of order. Les Montres de Prestige will confirm the acceptance of all orders to their customers by e-mail response to email address given at time of order. Final sale will be concluded only upon confirmation of order. Les Montres de Prestige reserves the right to refuse any orders from a customer with whom they have had commercial sales dispute, and in particular relating to any past due payment of orders.

Information given by the customer when the order was placed, commits him/her : in the case of an error being made in the wording of personal contact details (address and/or of phone number of the addressee), Les Montres de Prestige cannot be made liable for not being able to deliver said product.

Delivery :

After confirmation of order and subject to the entire global payment at agreed price of said products, Les Montres de Prestige is committed to sending to customer, under customer’s sole responsibility, products ordered at the delivery address given at time of order within a 48 hour period with the following exceptions : (temporary closure/lock out), any strike of shipping carriers, etc…).
All products delivered by Les Montres de Prestige are intended for personal usage of customers/addressees and customers/addressees refrain themselves from any partial or total resale of said products. For any deliveries outside of Metropolitan France, the customer commits to paying, upon receipt of said products , all applicable taxes, customs duties, current taxes and any other up-coming taxes to be paid by virtue of the laws applicable within the country of receipt of said order; the collective responsibility of Les Montres de Prestige will not, at any time, be engaged for these additional costs. Delivery will be made by UPS or by another specialized shipping/transportation company of your choice and any related eventual delays will not justify any customer claim for damages.
Upon receipt of ordered products, the customer/addressee must verify the proper functioning of the delivered products and will acquaint themselves with instructions provided for the proper use of the timepiece.
In case of any visible defects, the customer will benefit from their right of return in terms and conditions specified in the instructions for the use of our products. Wars, riots, fires, strikes and accidents are considered to be cases of “acts of nature” and will thus absolve the company of its legal obligation to deliver as well as the impossibility to supply said product.

Price :

All prices are stated in Euros.
All prices indicated on the product characteristic sheet do not include any shipping costs.
The price indicated in the confirmation of order sheet/form is our definitive price, expressed inclusive of all taxes and including VAT.

Payment :

The price being charged to the customer is the same price indicated on the confirmation of order sent by Les Montres de Prestige.
The price of our products are payable as of the order date.

Cancellation :

The customer has a time frame of 7 days as of receipt of products ordered to return them to Les Montres de Prestige for exchange or refund. In this case, the customer will return said products in original packaging envelope, intact, accompanied with all accessories and documentation to the following address: LIMITED COMPANY NL3M 6 street Edouard Herriot 84000 Avignon France

In the case of any cancellation of orders, Les Montres de Prestige commits to paying stated sum to the customer with the exception of any expenses related to the product’s return. This refund is due within a maximum period of 30 days.

Applicable laws :

Our present general terms and conditions of sale are subject to current French law.

Responsibility :

Les Montres de Prestige cannot be considered in any way liable/responsible for any damages of any kind, whether they be material, immaterial or of a physical aspect, which resulting from the improper use of the product or from misuse of the marketed products. The same will apply for any possible modifications of products resulting by the manufacturer. The responsibility of Les Montres de Prestige will be limited, in any case, to the amount of the order and cannot in any way be liable for any errors or omissions that remain/exist despite all precautions taken in the presentation of said products. In the case of any issues in the application of our present contract, buyer and Les Montres de Prestige have the right, prior to any legal action to look for an amicable solution.
By default, the Commercial Court of Avignon will be the only court considered competent, despite country of delivery any accepted method of payment.

Guarantee :

Les Montres de Prestige cannot be considered liable for any non compliance to current regulatory and legislative measures applicable in the country of receipt of product. The responsibility of Les Montres de Prestige is systematically limited to the value of the said products, the value at the date/time of sale, without any possible appeal to the brand or company manufacturing the product.
In any case, the customer will benefit from the legal guarantee of eviction and from any undisclosed defects (Art. 1625 and following the Civil code .

Legal informations:

All communication of specific information gathered for the purpose of remote sale is mandatory and this information is mandatory for the treatment and routing of orders as well as issuing invoices and contract guarantees. Failure to comply with providing proper information will invalidate said order. According to the law " computing information and liberties act ", the treatment of client list of names and related information concerning customers was the object of a declaration to the National Commission of the Computing Information and Liberties. Article 34 of the law of January 6th, 1978 gives the customer the right of access, modification, rectification and deletion of data pertaining to them, which can be exercised with Les Montres de Prestige. Furthermore, Les Montres de Prestige commits to not sharing or communicating, whether it be free of charge or with a financial compensation, the personal information (address and phone number) of their customers to a third party.
